In an op-ed for Bloomberg Law published on Sept. 30, 2025, Judge Paul W. Grimm (ret.), director of the Bolch Judicial Institute of Duke Law, reflects on tensions between the federal district courts and the U.S. Supreme Court over emergency applications filed by the Trump administration.
“There is cause for concern that recent critical comments by federal trial judges and the US Supreme Court justices regarding each other’s handling of the Trump administration’s emergency applications reflects a house divided against itself,” he writes, citing a Biblical passage that became Abraham Lincoln’s famous warning. He calls on attorneys and organizations to help defend judges and the judicial system against unfair attacks, but also for greater unity within the federal judiciary.
“As a divided house is subject to falling,” he concludes, “a united one sits upon an enduring foundation.”
