The Bolch Judicial Institute at Duke Law is seeking comments from the bench, bar, and public on a preliminary draft of Guidelines And Best Practices Implementing 2018 Amendments To Rule 23 Class Action Settlement Provisions. This document was prepared under the leadership of an editorial board composed of eight distinguished practitioners drawn from the plaintiffs’ and defense bars. Thirty additional volunteers formed four more drafting teams, with a plaintiff and defense team leader from the editorial board leading each team. The document aims to help the bench and bar comply with the proposed 2018 amendments to Rule 23, which take effect in December.

Comments on this preliminary draft will be carefully considered by the drafting team and an advisory group of judges as they finalize the document for publication.
